Welcome to SoulKind™ Apparel. The terms “we,” “us,” and “our” refer to SoulKind™ Apparel, a brand under Beast Holdings LLC (“SoulKind™ Apparel”). SoulKind™ Apparel operates this store and website, including all related information, content, features, tools, products, and services to provide you, the customer, with a curated shopping experience (the “Services”). SoulKind™ Apparel is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Made-to-order / on-demand production: Many of our products are produced on demand after an order is placed. Production times may vary.

When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, or limit any order in our discretion. An order is not accepted until we confirm acceptance, and we must receive and process payment before acceptance.
Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted or production has begun.
If we do not accept, modify, or cancel an order, we will attempt to notify you using the email, billing address, or phone number you provided.
Final sale and refunds: Purchases are subject to our Refund Policy: REFUND POLICY LINK. Except as required by law or as stated in our Refund Policy, all sales are final.
You represent and warrant that purchases are for personal or household use and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be shown in your order confirmation.
Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.

Delivery times are estimates and not guaranteed. We are not liable for shipping delays caused by carriers, customs, or events outside our control.
Risk of loss: Title and risk of loss pass to you when the package is transferred to the carrier.
Delivered packages: We do not cover packages marked “delivered” by the carrier. You are responsible for providing accurate shipping information.
SECTION 6 — RETURNS, EXCHANGES, AND REPLACEMENTS

In general, we do not offer returns or exchanges. Replacements may be provided only for items that are damaged, defective, or materially incorrect, as described in our Refund Policy, and must be reported within the stated time window with photo documentation.

We may provide access to tools offered by third parties that we do not monitor or control. You acknowledge we provide such tools “as is” and “as available” without warranties or endorsement, and we are not liable for your use of optional third-party tools.

SoulKind Apparel is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with SoulKind Apparel. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and SoulKind Apparel, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SoulKind Apparel.

If you submit ideas, suggestions, feedback, reviews, proposals, plans, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial use.
You represent and warrant that you own or have all necessary rights to the Feedback, have disclosed any compensation or incentives received (if applicable), and that your Feedback complies with these Terms.

SECTION 20 — DISPUTE RESOLUTION; INFORMAL PROCESS; ARBITRATION; CLASS ACTION WAIVER
Informal dispute resolution: Before filing a claim, you agree to first contact us and attempt to resolve the dispute informally. Unless prohibited by law, you agree to allow at least 30 days for informal resolution.
Binding arbitration: If we cannot resolve a dispute informally, you and SoulKind™ Apparel agree that, to the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to the Services, these Terms, or any transaction with SoulKind™ Apparel will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small claims court if it qualifies.
No class actions: You and SoulKind™ Apparel agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding.
Chargebacks: You agree to contact us and attempt informal resolution before initiating a chargeback with your payment provider, unless prohibited by applicable law.
This section does not limit any rights that cannot be waived under applicable law.
SECTION 21 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, the provision will be enforceable to the fullest extent permitted by law, and the remaining provisions will remain valid and enforceable.

Failure to enforce any right or provision is not a waiver.
